Appeal process

A person who made a submission on the proposed Regional Policy Statement may appeal to the Environment Court. The appeal can only relate to matters covered in the submitter’s original submission.

Any appeal to the Environment Court must be in the prescribed form and lodged with the Environment Court within 30 working days of receiving notice of the Council’ decisions. A notice of appeal must include:

  • Your full name
  • A statement that you made a submission on the proposed Regional Policy Statement for the Wellington Region
  • The date you received notice of the decision
  • A summary of the decision or part of the decision you are appealing and the specific provision your appeal relates to
  • Reasons for you appeal
  • Relief sought

You must include with your appeal:

  • A copy of your submission or further submission (with a copy of the submission opposed or supported by your further submission)
  • A copy of the relevant decision (or part of)
  • Any other documents that will provide a good understanding of your appeal
  • A list of names and addresses of person to be served with a copy of the notice (You must serve a copy to Wellington Regional Council at the same time as the Environment Court and to every person who made a submission to which the appeal relates within 5 days after this)
  • Within 10 days of lodging your notice with the Court you must let the Court know in writing the name, address, and date of service for each person served with this notice.

Sign and date your notice of appeal and provide an address where documents can be sent, together with contact telephone number and e-mail address (if you have one).
